• Melissa Groo v. Montana Eleventh Judicial District Court (2023 MT 193, filed October 11, 2023) Served as counsel for Plaintiffs/Respondent in this groundbreaking case before the Montana Supreme Court regarding specific personal jurisdiction over Defendant Groo, a resident of New York, for Plaintiffs’ claims she tortiously interfered with Plaintiffs’ Montana business via statements on social media. The Montana Supreme Court ruled that Defendant Groo’s purposeful and substantial use of social media to attack Plaintiffs’ business warranted the Montana Court’s exercise of personal jurisdiction.

  • David Bradley Himel, an individual and 50% owner of Cryb Holdings, LLC a Florida Limited Liability Company, Plaintiff vs. Layth Samarah, an individual and 50% owner of Cryb Holdings, LLC a Florida Limited Liability Company, Defendant, in the Circuit Court, Fourth Judicial Circuit, Duval County, Florida; Case No. 2022-CA-004801 (Judgment Filed October 10, 2023) Served as counsel for Plaintiff in this cryptocurrency fraud/partnership fraud case alleging the Defendant defrauded investors and Plaintiff, his partner. Obtained summary judgment on all Plaintiff’s claims and a final judgment against defendant in the amount of $1,852,820.

  • Jose Remigio Zapata v. State of Montana, Cascade County Montana and Planned Parenthood of Montana et al., CV-21-79-GF-BMM-JTJ (D. Montana 2023) Served as counsel for Plaintiff in this federal civil rights violation case alleging violations of Plaintiff’s constitutional rights while in the pretrial custody of defendants State of Montana and Cascade County Montana. Achieved settlement of all claims for Plaintiff against the State of Montana, Cascade County Montana and Planned Parenthood of Montana.

  • Scott G. Cooney v. Territorial-Landworks, Inc. (IMEG), DV-18-899 (Montana District Court, Missoula County 2022) Served as counsel for the Plaintiff real estate developer in this professional negligence and breach of contract case against the engineering firm Plaintiff hired to provide engineering and consultation on Plaintiff’s real estate development project. Achieved settlement of all claims for Plaintiff against this engineering firm prior to trial.

  • Jeffrey Craig Porter, Jr and “KRP” v. Town of Darby, Montana, et al., CV-20-M-DLC-KLD (D. Montana 2020) Served as counsel for Plaintiff in this federal civil rights violation case alleging violations of Plaintiffs’ constitutional rights by unlawfully searching Plaintiffs’ home, unreasonably seizing Plaintiffs and violating Plaintiffs’ right to privacy. Achieved settlement of all claims for both Plaintiffs prior to trial.

  • Kevin Washington v. Matthew Brent Goettsche, CV 20-2-BU-BMM-KLD; FX Solutions, Inc. v. Matthew Brent Goettsche, CV-03-BU-BMM-KLD (D. Montana 2020) Served as counsel for Plaintiffs in these consolidated federal cases alleging fraud, breach of fiduciary duty and breach of contract. Federal court granted Plaintiffs’ emergency motion for appointment of a receiver to operate and conserve assets of a Bitcoin mining facility at Butte, Montana. Represented Plaintiffs before the Receiver in operating the Bitcoin mining facility while litigating complex tort and contract claims in federal court. Led settlement negotiations that resulted in termination of the receivership and clients receiving multi-million dollar assets.

  • Asarco LLC v. Montana Resources, Inc., 12-CV-137 (USDCT S. D. TX. 2019) Breach of partnership agreement case. Served as co-counsel for Asarco LLC in federal proceeding that resulted in multi-million dollar settlement for client.

  • Asarco LLC v Atlantic Richfield Company, (CV-12-53-H-DLC, D. Montana 2018), 975 F3d 859 (Ninth Circuit 2020, aff’d in part) CERCLA contribution case. Served as co-trial counsel for Asarco LLC in federal trial resulting in a $28.7 Million judgment for client.
